Recent changes to estate legislation in Alberta now cause a gift in a will to a former spouse to be revoked, unless a contrary intention can be shown. However, this new rule only applies to situations where the divorce was granted after the changes were proclaimed, which happened in February 2012. If you were divorced before 2012, a gift to a former spouse is likely still valid. This may not be what you intend to happen!  Even if you were divorced after February 2012, it is well worth it to review your will and make sure it fits your current situation, as there are other important changes in the new legislation as well. Talk to a lawyer today about how these changes may affect your estate planning.
