Unlike the tables for child support, which are law pursuant to the Divorce Act, the Spousal Support Advisory Guidelines have never been enacted and are an informational tool only. The danger in relying on just these tables is that only some crucial considerations are addressed. The first question – what factors affect entitlement to support – involves considering income as well as the parties’ circumstances (age, employment opportunities, parenting responsibilities, health, roles during the marriage, ability to pay and so on). This question is not dealt with by the spousal support tables. Deciding on spousal support can be complex so getting good legal advice regarding your rights is important.
